Why DCI has dropped charges against former interior CS Dr Fred Matiang’i

The Director of Criminal Investigations says it forwarded an inquiry file to the Office of the Director of Public Prosecution through a letter dated 7th March, 2023 under
reference CI/TB/SCU/SEC/2/3/VOL.XII/39, forr perusal and advise and the same was received by the Office on 8th March, 2023.

The inquiry file, according to DCI relates to allegations that Dr. Fred Okego Matiangi on 8 and 9thbFebruary, 2043 jointly conspired with another to publish in the melia to wit “The former CS for interior was invaded with a garrison or battalion of unidentifed people from the security apparanus of this country either EACC, either KWs, either
The police..”

The recommendation by the investigating officer, DCI details, was that Dr. Fred Okengo Matiang’i and his advocale Mr. Dunstan Omari be charged for the following offences:

Conspiracy to commit a felony contrary to section 393 of the Penal Code, Publication of false inforation contrary to seclion 23 of the Compuler and Misuse and Cybercrime Act No. 5 of 2018

DCI details that upon independent and thorough analysis of the evidence availed and a review of the statements of the witnesses, the Dirctor of Public Prosecutions found that the evidence provided was not sufficient to sustain the abuve charges against Dr. Fred Okego Matiang’i and his advocate Mr. Daustan Omari.

The evidence provided did not meet the the ingredients needed to prove each of the afore-nentioned offences as
required by law

The Director of Public Prosecutions has therefore directed the Diretorate of Criminal Investigations to close the inquiry file with no further poliee action.

The drop of the case comes hours after Matiang’i meeting with Education CS Ezekiel Machogu, Shadrack Mose, North Mugirango MP Joash Nyamoko and Gusii elders. The team reportedly discussed on how to move forward as a united front. President Ruto will be reportedly visiting Kisii and Nyamira on 24th March.
