Former CJ Maraga Furious as Govt Withdraws His Security After Police Criticism

Nairobi, Kenya – June 27, 2025 – Retired Chief Justice David Maraga has publicly condemned the sudden withdrawal of his security detail, linking the move to his recent criticism of police misconduct. In a strongly worded letter addressed to Interior Cabinet Secretary Hon. Onesimus Kipchumba Murkomen and Inspector General of Police Douglas Kanja Kirocho, Justice Maraga demanded the immediate restoration of his security, citing constitutional guarantees under the Retirement Benefits Act.

Maraga’s Security Withdrawn Amidst Police Tensions

The former Chief Justice Maraga revealed that on June 25, 2025—the same day he participated in a Nairobi CBD march commemorating victims of police brutality—one of his assigned officers was abruptly redirected for “firearm register updates” and later informed of an impromptu training session. By June 26, all remaining officers were recalled without explanation.

CJ Maraga expressed suspicion that the withdrawal was retaliatory, given his vocal stance on the unresolved murder of Albert Owang, a suspect who died in police custody. “It is curious that my security was pulled immediately after I called for the prosecution of senior officers involved in Owang’s case,” he stated.

Legal and Constitutional Violations

Under Section 5A of the Retirement Benefits (Deputy President and Designated State Officers) Act, retired state officers, including the Chief Justice, are entitled to police security upon request. David Maraga emphasized that his security had been uninterrupted since his retirement in January 2021 until this sudden recall.

“The law is clear,” he wrote. “These benefits are not discretionary but a right. I demand their immediate restoration.” Legal experts argue that withdrawing security from a retired CJ Maraga without due process could set a dangerous precedent for judicial independence.

Public Backlash and Political Reactions

Human rights groups and opposition leaders have rallied behind Maraga, accusing the government of intimidation. “This is an attempt to silence dissent,” said Law Society of Kenya President Eric Theuri. “If a former Chief Justice isn’t safe, who is?”

The Interior Ministry has yet to respond, but sources suggest the recalls were “routine reassignments.” Skeptics, however, note the timing aligns with Maraga’s recent activism, including his push for police accountability.

Why This Matters

The incident raises concerns about:

  1. Judicial Independence: Retired judges require protection to speak freely without fear of reprisal.
  2. Police Accountability: Maraga’s criticism of the Owang case highlights systemic impunity.
  3. Rule of Law: If the state can arbitrarily revoke benefits, constitutional safeguards erode.

What’s Next?

Justice Maraga has vowed to pursue legal action if his security isn’t reinstated. Meanwhile, Kenyans await the government’s response, with many viewing this as a test of Kenya’s commitment to democratic principles.
