The Controller of Budget Margaret Nyakango and 10 others are set to face charges including conspiracy to defraud, operating an unlicensed Sacco, forgery, and uttering a false document according to media reports.
The arrest in Mombasa follows a 2016 complaint, predating Nyakango’s tenure as CoB.
The charges against the controller of budget were reportedly approved by the DPP on November 30, and Nyakango was trailed and arrested during a public event.
Efforts to apprehend the others are ongoing.
Nyakango, in office since June 2020, has been vocal about fiscal concerns, warning of potential challenges due to a weakening shilling and increased public debt.
A charge sheet seen by k47 digital news team read: “We acknowledge receipt of your letter Ref. No. DCI/SEC/LCA/4/4/16/VOL. VII/24 dated 31 Octoler 2023 resubmitting the duplicate inquiry file in this matter for directions.
“We note that the file was first submitted for perusal and advise on 6h July, 202n, upon perusal we identified some areas that needed to be covered. Vide our letter Ref. No covered.
“Purther the file was re-submitted on 14 November, 2022 and the Office of the Director of Public Prosecutions vide letter Ref. No. ODPPHQ/CAM/2/o00389 dated 1st December, 2022 directed that there was sufficient evidence to charge the suspects.
“The file was again re-subnitted to the Office of the Director of Public Prosecutions vide letter Ref. No. DC/SEC/LCA/4/4/16/VOL.VII/24 dated 31 October, 2023 for further directions and upon perusal of the new evidence, we find that the following persons are criminally culpable,

We therefore direct that all the aforementioned suspects be charged jointly with the following
charges;
- Conspiracy to defraud contrary to Section g17 of the Penal Code;
- Operating a Sacco without a Licence Contrary to Section 24 as read with Section 66 of the Sacco Societies Act, 2008.
- Forgery c/s 345 as read with section 349 of the Penal Code.
- Uttering a false document c/s 353 of the penal code.
