In a press release dated February 28, 2024, the Kenya Film Classification Board (KFCB) expressed deep concern over the surge of unrated and inappropriate audio-visual content on various media platforms, particularly social media. The Board, responsible for regulating film and broadcast content in the country, highlighted the detrimental impact of such content on children and the public at large.

During the mid-term break for students and pupils, the Board noted a troubling influx of content that violates the Films and Stage Plays Act Cap 222 of the Laws of Kenya. Some local artists, including Chris Embarambamba with his latest song “Niko Uchi” and William Getumbe with the controversial “Yesu Ninyandue,” have come under scrutiny for producing content that not only contravenes the law but also raises concerns about its appropriateness.

The press release emphasized that the content, often disguised as art and freedom of expression, is being propagated on social media and other platforms. The Board’s Media Monitoring Department has received numerous complaints from the public regarding these inappropriate audio-visual materials.

One of the highlighted songs, “Niko Uchi,” purportedly gospel, was criticized for ridiculing the Christian religion and containing nudity and vulgarity. Additionally, certain dance styles were deemed violent and presented imitable behavior that could be dangerous if copied by children. The Board underscored the need for responsible creation and dissemination of content, especially when it comes to minors.

The press release also addressed instances of inappropriate content involving religious acts by an individual named ‘Johanna.’ This adult, using religious influence, engaged in indecent exposure performances with sexual innuendos within a religious institution where minors may be present. The Board expressed deep concern over adults, who should be protecting children, leading the circulation of such inappropriate videos.

As a government entity mandated to regulate film and broadcast content, the KFCB made several key points in response to these concerns:

Filming without a license contravenes the Films and Stage Plays Act, and no film should be distributed without the Board’s examination and approval.
While recognizing freedom of expression, the Board highlighted its limitations, urging content creators to consider cultural and moral values.

Parents, caregivers, and guardians were urged to monitor and control children’s access to inappropriate content on various platforms during the mid-term break.
Content creators were reminded to adhere to laws governing the creative industry and avoid compromising cultural and moral values.

To address the issue, the Board issued demand letters to Chris Embarambamba and William Getumbe, instructing them to remove inappropriate content from their platforms. Simultaneously, letters were sent to relevant platforms requesting the removal of such content. The Board assured the public of its commitment to monitoring and reporting inappropriate content to relevant government agencies and platform operators.

In conclusion, the KFCB acknowledged the support of the public in monitoring and reporting such cases and encouraged continued vigilance. Complaints were directed to be forwarded to info@kfcb.go.ke.

Nelly Muluka, acting Chief Executive Officer of the Kenya Film Classification Board, signed the press release, emphasizing the Board’s dedication to maintaining cultural values and protecting the public, particularly children, from harmful content circulating on media platforms.
