President William Ruto’s recent appointment of 19 new Cabinet Secretaries (CSs) has been met with significant legal challenges, as a petition was filed in the High Court seeking to revoke their appointments. The Kenya Human Rights Commission (KHRC) and activist Wanjiru Gikonyo are leading the challenge, citing several constitutional violations in the appointment process.

The petitioners argue that the vetting process for these Cabinet members failed to uphold key constitutional requirements, particularly in terms of integrity and public participation. They allege that the National Assembly did not conduct a thorough vetting process and ignored concerns raised by the Ethics and Anti-Corruption Commission (EACC) regarding some of the nominees. Notably, they highlighted the appointment of Wycliffe Oparanya, who has unresolved integrity issues according to the EACC, as particularly problematic.

Moreover, the petitioners contend that the public was not adequately involved in the vetting process, as the criteria for selecting candidates were not made available beforehand. This lack of transparency, they argue, deprived the public of the opportunity to contribute meaningfully to the selection of individuals who hold such significant public office.

The legal challenge also questions the overall legality of the appointments, claiming they were made in contravention of the Constitution. The petitioners are seeking a court order to nullify the appointments and direct President Ruto to restart the process, this time adhering strictly to the law and ensuring proper public participation.
